Please read these Terms carefully. They are a binding agreement between you and Dheeraj Kumar Sharma, an individual based in India (“StepUp”, “we”, “us”), covering your use of the StepUp iPhone app and its widgets (the “App”).

By downloading, signing in to, or using StepUp, you accept these Terms. If you do not accept them, do not use the App.


1. The health disclaimer: please read this one

StepUp is a fitness and wellness app. It is not a medical device and it does not provide medical advice.

  • Nothing in the App is a diagnosis, a treatment, a prescription, or a professional medical opinion. That includes every metric, every insight, every walking plan, every target and every notification.
  • StepUp’s metrics, including Pace, Evenness, Effort and Fitness, are broad comparisons of your own data against itself over time. They are not clinical measurements and must not be used to detect, monitor, treat or rule out any condition.
  • Step counts, distances, calorie estimates, heart rate and gait measurements come from Apple Health and from the sensors in your iPhone and Apple Watch. They are estimates and can be inaccurate. Do not rely on them where accuracy matters.
  • Consult a qualified healthcare professional before starting any new exercise programme, and especially if you are pregnant, are over 65, have a heart condition, have an injury or a chronic illness, or have been inactive for a long period.
  • Stop exercising and seek medical help immediately if you feel chest pain, dizziness, shortness of breath or any other warning sign. Do not wait to finish a plan, a goal or a streak.
  • You are solely responsible for deciding how much to walk. A goal, streak or nudge from StepUp is encouragement, never an instruction.

In an emergency, call your local emergency number. Do not use StepUp.


2. Who may use StepUp

You must be at least 13 years old (or 16, if you are in a country where that is the minimum age for consenting to data processing) to use StepUp. If you are under the age of majority where you live, you may use StepUp only with the involvement of a parent or guardian, who accepts these Terms on your behalf.

You need a compatible iPhone running iOS 17 or later, an internet connection, and an Apple Account.


3. Your account

StepUp requires an account. You sign in with Sign in with Apple or with Google. We never create or hold a password for you.

You agree to:

  • provide accurate information and keep it current;
  • keep control of the Apple or Google account you sign in with;
  • be responsible for everything that happens under your StepUp account;
  • tell us at dheerajsh.codes@gmail.com if you believe your account has been compromised.

One account is for one person. Do not share it, sell it, or create an account for someone else without their permission.

You may delete your account at any time from Profile → Delete Account. This permanently removes your account data from our servers and clears StepUp’s data from your device. It does not cancel an active subscription. See §6.


4. Your licence to use StepUp

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use StepUp on Apple-branded devices you own or control, for your own non-commercial use, in accordance with the App Store Terms of Service and Apple’s Licensed Application End User Licence Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ (the “Apple Standard EULA”). The Apple Standard EULA governs the software licence itself; these Terms govern the StepUp service, your account and your subscription. Where the two genuinely conflict on a licence matter, the Apple Standard EULA governs.

You may not, and may not allow anyone else to:

  • copy, modify, translate, or create derivative works of the App;
  • reverse engineer, decompile or disassemble the App, except to the extent that applicable law expressly permits it despite this restriction;
  • rent, lease, lend, sell, sublicense or distribute the App;
  • remove or obscure any copyright, trademark or other proprietary notice;
  • access the App by any automated means, or attempt to circumvent StepUp Pro, our paywall, rate limits or security controls;
  • probe, scan, overload or disrupt our servers, or attempt to gain unauthorised access to any account or system;
  • use the App unlawfully, or in any way that infringes someone else’s rights.

We may suspend or terminate your access if you break these rules.


5. Apple Health

StepUp reads activity data from Apple Health only after you grant permission, and only to show you your own progress inside the App and its widgets.

  • StepUp never writes to Apple Health and never deletes anything from it.
  • Your Health data is processed on your device and is not transmitted to us.
  • You can revoke access at any time in iOS Settings → Health. StepUp will then have little or nothing to show, which is expected, not a defect.
  • We use Health data only as described in our Privacy Policy, and never for advertising or marketing, and never for sale or disclosure to a third party.

6. StepUp Pro: subscriptions and purchases

6.1 What is free and what is paid

StepUp is free to download. The free version includes Apple Health sync, today’s steps, distance, calories and flights, your daily step goal, the day, week, month and year dashboards and calendar, the Momentum metric, reminders and nudges, share cards, the Daily Steps widget, and the first week of your walking plan.

StepUp Pro unlocks your full walking plan and plan history, the Trend, Tempo, Pace, Evenness, Climb, Effort, Routine and Fitness metrics, and the Step Totals, Daily Goal and Walking Stats widgets.

6.2 Plans

StepUp Pro is offered as an Individual plan and a Family plan. Both unlock exactly the same features; Family adds Apple Family Sharing so that up to six members of your Apple Family group get access. Each plan is available monthly, annually, or as a one-time Lifetime purchase.

Current prices, currencies and any free trial are shown in the App before you buy, as supplied by the App Store for your country. The price you are shown at the point of purchase is the price that applies.

6.3 Free trial

Annual plans may include a 7-day free trial for eligible new subscribers. Your subscription begins and you are charged when the trial ends, unless you cancel at least 24 hours before it does. If you have already used a trial in this subscription group, you are not eligible for another. Monthly and Lifetime purchases include no trial.

6.4 Billing and automatic renewal

Subscriptions renew automatically. Payment is charged to your Apple Account at confirmation of purchase, and again within 24 hours before the end of each period, at the then-current price, until you cancel. Your account is billed monthly or annually according to the plan you chose.

6.5 Cancelling

Manage or cancel your subscription in Settings → [your name] → Subscriptions on your iPhone, or through the link in StepUp’s Profile screen. Cancel at least 24 hours before the period ends to avoid the next charge. Deleting the app or your StepUp account does not cancel your subscription. Only Apple can do that.

When you cancel, Pro stays active until the end of the period you already paid for.

6.6 Lifetime

Lifetime is a one-time, non-consumable purchase that unlocks StepUp Pro for as long as StepUp is available on the App Store and you retain the Apple Account you bought it with. It is not a personal guarantee of perpetual service, and it does not entitle you to features later sold as a separate product.

Buying Lifetime does not cancel an existing subscription. Apple does not allow one purchase to cancel another. If you are subscribed and buy Lifetime, you must cancel the subscription yourself, and the App will keep prompting you to do so until you have. We are not able to refund charges that occur because a subscription was left running.

6.7 Refunds

All purchases are processed by Apple, and all refunds are handled by Apple under the App Store Terms of Service. We cannot issue, approve or reverse a refund. Request one at https://reportaproblem.apple.com. Except where the law of your country requires otherwise, purchases are non-refundable and unused portions are non-refundable.

6.8 Family Sharing

If you buy a Family plan, entitlement is shared through Apple Family Sharing. Each member needs their own StepUp account, grants their own Apple Health permission, and gets their own plan and their own data. No family member ever sees another member’s health data, steps or walking plan. If you leave the family group or the organiser turns purchase sharing off, access ends.

6.9 Price and plan changes

We may change prices or restructure plans. A price increase to an existing subscription takes effect only after Apple has given you notice and, where required, obtained your consent; otherwise your subscription will not renew. A change never affects a period you have already paid for.

6.10 If you stop paying

Losing Pro never deletes anything. Data already recorded stays recorded, and a walking-plan week already generated stays readable. Only future weeks and locked history need Pro again.


7. Notifications

With your permission, StepUp sends reminders and nudges about your own progress. These are created on your device. You can turn them off in the App or in iOS Settings. Separately, you may opt in to occasional product announcements from us; these never refer to your activity.

Notifications are delivered by Apple and are not guaranteed. Do not rely on StepUp for any time-critical or health-critical alert.


8. Your content

Anything you create in StepUp remains yours: your display name, your goals, and a photo you add to a share card. You grant us only the limited licence needed to store it and show it back to you, and nothing more. We do not use your content for marketing.

You are responsible for what you choose to share outside the App. A share card you post is public because you made it public.


9. Our intellectual property

StepUp, the StepUp name and logo, the App’s design, code, text, metric definitions and the walking-plan methodology are owned by us and protected by copyright, trademark and other laws. These Terms grant you no rights in them beyond the licence in §4.

Apple, Apple Health, HealthKit, iPhone, Apple Watch and App Store are trademarks of Apple Inc. Google and Firebase are trademarks of Google LLC. StepUp is not affiliated with, sponsored by or endorsed by either.


10. Third-party services

StepUp relies on Apple, Google (sign-in, Firebase analytics and push), Supabase and RevenueCat. Their availability and their own terms are outside our control, and we are not responsible for their acts or omissions. See the Privacy Policy for what each one receives.


11. Availability and changes

We may add, change, suspend or discontinue any part of the App, and may release updates that you need to install for StepUp to keep working. We do not promise uninterrupted or error-free service, and features may vary by device, iOS version and country.

If we discontinue StepUp entirely, we will give reasonable notice where we can, and where the law requires a refund of a prepaid, unused portion, we will comply.


12. Disclaimers

To the fullest extent permitted by law, the App is provided “as is” and “as available”, without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

We do not warrant that the App will be uninterrupted, secure or error-free, that data shown will be accurate or complete, that defects will be corrected, or that using StepUp will produce any particular fitness, weight or health outcome.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here limits rights you have under mandatory consumer protection law, including, in the EU and UK, your statutory rights in respect of digital content, and in India, your rights under the Consumer Protection Act, 2019.


13. Limitation of liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to the App.
  • We are not liable for any injury, health consequence or death arising from physical activity you undertake, whether or not StepUp encouraged it. You exercise at your own risk.
  • We are not liable for inaccurate step, distance, calorie, heart rate or gait readings, for a missed or mistimed notification, or for loss of data held on your device.
  • Our total aggregate liability to you for all claims is limited to the greater of the amount you paid us for StepUp in the 12 months before the claim or USD 50.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by our negligence, for fraud, or for fraudulent misrepresentation.

You agree to indemnify us against claims arising from your breach of these Terms or your misuse of the App.


14. Apple’s role

You acknowledge that:

  • These Terms are between you and us, not Apple, and Apple is not responsible for the App or its content.
  • Apple has no obligation to provide maintenance or support for the App.
  • If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
  • Apple is not responsible for addressing any claim relating to the App, including product liability, regulatory non-compliance, or consumer protection claims.
  • If a third party claims the App infringes their intellectual property, we, not Apple, are responsible for that claim.
  • You represent that you are not located in a country subject to a US Government embargo or designated as “terrorist supporting”, and are not on any US Government prohibited or restricted party list.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and may enforce them against you.

15. Termination

You may stop using StepUp at any time by deleting your account and removing the App. We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if we discontinue the service.

On termination, your licence ends and §§8–14, 16 and 17 survive.


16. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict of law rules. The courts of Solan, Himachal Pradesh, India have exclusive jurisdiction, except that:

  • if you are a consumer in the EEA or the UK, you keep the protection of the mandatory consumer laws of your country of residence and may bring proceedings in your local courts. EU consumers may also use the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr;
  • if you are a consumer elsewhere, nothing here deprives you of a right to bring a claim in your local courts where your law guarantees it.

Before filing anything, please email dheerajsh.codes@gmail.com. Most problems are faster to fix than to litigate, and we will try in good faith to resolve it within 30 days.


17. General

  • Entire agreement. These Terms, the Privacy Policy and the Apple Standard EULA are the whole agreement between us about the App.
  • Changes. We may update these Terms. The date at the top will change, and for material changes we will notify you in the App or by email before they take effect. Continuing to use StepUp after that means you accept them.
  • Severability. If a provision is unenforceable, the rest stands.
  • No waiver. Not enforcing a right once does not waive it.
  • Assignment. You may not assign these Terms. We may, on notice, to a successor in connection with a merger, acquisition or sale of assets.
  • Language. These Terms are written in English; an English version governs.
